Nick Reiner could face the death penalty if convicted of the murders of his parents, Rob Reiner and Michele Singer Reiner.
Los Angeles County District Attorney Nathan Hochman said Nick will be charged with two counts of first-degree murder with special circumstances and a special allegation that he used a knife in connection with the deaths of his parents, who were found dead in their Los Angeles home on Sunday, Dec. 14.
According to Hochman, the charges carry a maximum sentence of life in prison without the possibility of parole or even the death penalty.
“No decision at this point has been made with respect to the death penalty,” Hochman said at a press conference, further noting that his office will take the family’s wants into consideration.
Nick has not yet appeared in court but he will be arraigned when he is deemed medically clear, the district attorney said.
Rob and Michele were found by their daughter, Romy, according to sources who spoke to the family.
The Los Angeles Fire Department said it responded to a call for aid at about 3:30 p.m. on Sunday. The victims were later identified as the Reiners.
Nick was arrested after 9 p.m. Sunday, over five hours after his parents were discovered. He is being held without bail at Los Angeles’ Men’s Central Jail.
Multiple sources previously told PEOPLE that Rob and Nick got into a “very loud argument” at a party hosted by Conan O’Brien on Saturday night.
